Six years after the parties divorce in 1983 the husband, Russell Elliot, filed a petition for a modification of the final decree of divorce in the Circuit Court at Shelby County. In its order the trial court dismissed the husbands petition and awarded $3,731.55 in attorney fees and expenses to the wife, Constance Carola Cowley Elliot.
